Terms of service

Draft, not yet in force. This page describes how the product is built to work and is waiting for legal review. It does not bind anyone until that review is done and this banner is gone.

Short, in plain English. These cover the Optestra web app and cloud. The open-source engine has its own licence (MIT), at its repository.

1. Who we are, and these terms

"We" means the company that operates Optestra [company name and address: to be completed]. By creating an account or using the service you agree to these terms. If you use it for an organisation, you confirm you can bind it.

2. Your account

You must give accurate details, keep your sign-in secure, and be responsible for what happens under your account. The service is for people aged 18 or over. One free allowance per person: don't create accounts to get around limits.

3. What you may test

You may point the service only at websites and apps you own, or have permission to test. Don't use it to attack, overload or probe other people's systems, to run load tests, to scrape, or to break the law. We may stop a run or suspend an account that does.

4. Your content

Your tests, recordings, files and results are yours. You give us the right to store and process them only to run the service for you. We don't use your content to train AI models, and the hosted AI route is pinned to a provider with zero data retention. See security and data.

5. Credits, plans and payment

  • Credits are a prepaid balance: 1 credit = 1 cent of cloud or AI work. Actions and their prices are on the pricing page and may change for future use; a price change never affects credits already spent.
  • Plan credits arrive each month and don't roll over. Top-ups start at $7 and last 12 months.
  • Payments are handled by Dodo Payments, our merchant of record, who sells the subscription or top-up to you under their terms, issues the invoice and collects sales tax. See refunds.
  • Subscriptions renew until you cancel; cancelling takes effect at the end of the period you've paid for.

6. The service

We work to keep the service available but don't promise it will be uninterrupted or error-free. A test's verdict is only as good as the test: you are responsible for deciding what your tests must check and for what you do with the results. A run that can't start because of us costs nothing.

7. Ending

You can stop using the service and delete your account at any time. We can suspend or end an account that breaks these terms, with notice where we can give it. Your tests are files in your repository: ending the service never takes them away.

8. Liability

To the extent the law allows, the service is provided "as is", and our total liability for any claim is limited to what you paid us in the 12 months before it [exact wording: for legal review]. Nothing here limits liability that can't be limited by law.

9. Changes and contact

We'll tell you about material changes to these terms by email or in the app before they apply. Governing law and courts: [to be completed]. Questions: [email protected].
